Terms & Conditions

These terms describe how Lux Empire delivers website design and development, hosting and care, social media management, digital marketing, integrations and related digital services.

Last updated: 6 October 2026

1. Our agreement and service scope

These terms apply to use of this website and services ordered from Lux Empire. Your accepted quotation, order and any written client agreement set out the specific deliverables, pricing, exclusions and responsibilities. A specifically agreed written term takes precedence over a general term here where they conflict, subject always to applicable law. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded, including under the Consumer Protection Act and Electronic Communications and Transactions Act where applicable.

Quotations are subject to their stated validity and assumptions. Work outside the agreed scope, additional integrations or changes to an approved brief require a revised quotation or written change approval. Services do not include unlisted deliverables or unlimited revisions.

2. Client content and approvals

You must provide accurate briefs, authorised access and content needed for the work, and ensure you have permission to use supplied logos, photographs, copy, data and other materials. You remain responsible for the accuracy and legality of business claims, disclosures and client-supplied content.

We request approval at agreed stages before proceeding to delivery, launch or publication. Review materials carefully and raise corrections promptly. Approval does not remove any applicable statutory rights or excuse our responsibility for agreed work. Delays in feedback or required approvals may affect delivery dates.

3. Deposits, payments and recurring fees

Deposits, milestones, payment due dates and any setup fees are specified in the quotation, order or client agreement; no universal deposit percentage applies. Work may depend on receipt of an agreed payment. Recurring hosting, care, social media and other ongoing fees are charged according to the agreed billing frequency and scope. Any recurring payment authorisation must be agreed separately through the applicable payment process.

Additional third-party charges and taxes, where applicable, must be identified in the relevant pricing or agreement. A service-scope or fee change must be communicated and agreed where required; this website does not retrospectively change the price of an existing order. Payments may be processed through PayFast or another identified payment provider, subject to that provider's terms.

4. Timelines, revisions and change requests

Delivery dates depend on the agreed brief, timely payments, access, content, feedback and third-party availability. We will communicate material delays and discuss an adjusted timeline. A new brief, additional revisions beyond the agreed allowance or changes after approval may affect both cost and completion date; these will be assessed before additional work proceeds.

5. Domains, hosting and third-party platforms

Domains, hosting, software licences, payment gateways, social platforms and external integrations may have separate fees, renewal dates and provider terms. The quotation or agreement identifies who manages these and which costs are included. Access or transfer may depend on provider requirements and account ownership.

Third-party outages, policy changes, account restrictions or discontinued features may affect services. We cannot guarantee uninterrupted external platforms, advertising results, search rankings, audience growth or revenue. Where an external change affects agreed work, we will discuss practical options and any additional scope.

6. Intellectual property and handover

You retain ownership of materials you supply. Ownership or licences for bespoke deliverables, source files and handover access are defined in the client agreement and normally depend on settlement of the relevant agreed fees. Third-party materials remain subject to their licences; pre-existing tools, reusable methods and components are not automatically transferred.

The agreed handover covers the specified deliverables and authorised access. Ongoing support, maintenance, source-file delivery and migration assistance are included only where agreed. Any use of your work in a portfolio must respect applicable permissions and confidentiality obligations.

7. Suspension, cancellation and termination

Unpaid fees, misuse, unlawful content or material breach may lead to service suspension or termination, subject to the agreement and applicable law. Where practicable, we will give notice of the issue and an opportunity to resolve it; urgent security or legal concerns may require immediate action. Suspension of hosting or connected services can affect availability.

Cancellation, notice, any outstanding work and handover arrangements follow your agreement and our Refund & Cancellation Policy. Statutory cancellation and refund rights remain unaffected.

8. Responsibility and limitation of liability

We will exercise reasonable care and skill in delivering the agreed services. You should keep appropriate copies of your business content and records; backup and recovery services apply only to the agreed scope. To the extent permitted by law, Lux Empire is not liable for indirect or consequential losses or losses caused by matters outside its reasonable control. This does not exclude liability for fraud, gross negligence, wilful misconduct or any liability that cannot lawfully be limited, nor does it restrict mandatory consumer remedies.

9. Governing law and resolving concerns

South African law governs these terms. Please contact us first with a service or billing concern so we can assess it and seek a fair resolution. This does not prevent you from using applicable consumer remedies, regulators or a court with jurisdiction. Updates to these general terms do not retrospectively override an existing signed agreement or your statutory rights.
